We here at Andale, referred to as "Andale" throughout the rest of this privacy policy, recognize that when you choose to provide us with information about yourself, you trust us to act in a responsible manner. We at Andale take the trust you have placed in us very seriously. We believe that your information should only be used to provide you as a merchant customer ("Seller") and/or you as a Seller's customer ("Buyer") with the best service possible. As Andale expands its services to better meet your needs, we may partner with more companies. As such, this privacy policy may also be expanded or amended. Please check back periodically for updates and contact us with any questions that you may have regarding Andale's privacy policy.

WHAT PERSONAL INFORMATION DOES ANDALE COLLECT AND WHY?

To provide you with the best service possible as a Buyer and/or a Seller, we collect some or all of the following information:

• your name
• email address
• marketplace ID and password (eBay)
• your payment method information

ANDALE STRIVES TO COLLECT THE MINIMUM AMOUNT OF INFORMATION NEEDED TO SUCCESSFULLY SERVICE YOUR BUYING AND/OR SELLING NEEDS.

When you use Andale's services we track your activity on our website. Your personal information is used to identify you in our system allowing Andale to interact with marketplaces on your behalf, pay for your use of Andale services, and to contact you about the status of our service and any changes to our service via email or telephone. We also use the information gathered from tracking user activities to improve our service. In addition, if you utilize Andale as a Buyer or purchase directly from an Andale seller, your personal information - that you provide to us - is used to identify you to Sellers so that the transaction can be successfully completed. We also track your Internet Protocol (IP) address, domain name (if applicable), browser type, session duration, and transaction data-which is available to any site to which you connect. Andale uses this information to administer the site and to further improve our service to you. We collect information throughout the site that may be needed to manage your listings before, during and after your successful and unsuccessful transactions.

If you elect to submit your email address in the "Previews, News & Updates by email" service offered by Andale, you will periodically receive emails from us updating you of significant events taking place at Andale. You can always unsubscribe from this list by following the "unsubscribe" instructions provided in the email correspondences.

Andale, manages a message board. Disclosing personally identifiable information on the message board makes the information submitted public information and such disclosure might increase your risk of receiving unsolicited email or spam. Please use your discretion when disclosing information online.

HOW DOES ANDALE USE YOUR INFORMATION?

Andale uses your information in two different ways:

1. facilitate transactions between Sellers/Buyers and the relevant marketplaces
2. research usage patterns based on the information provided to us during registration, checkout, promotions, and from our server log files. We do this to better understand your needs and enhance our service to you.

WITH WHOM DOES ANDALE SHARE YOUR INFORMATION?

Andale only shares your personally identifiable information with Sellers/Buyers as appropriate to the transaction at hand, to the marketplaces in order to complete your sales/purchases, and as directed by you, to credit card processors to facilitate sales transactions, and in cooperation with law enforcement inquiries and other third parties to enforce laws, intellectual property and other rights. Andale reserves the right to disclose personally identifiable information as we in our sole discretion believe necessary or appropriate in connection with a private party or governmental investigation of fraud, intellectual property infringements or other activity that may expose Andale to legal claims.

If you utilize Andale's services as a Seller, we pass on your marketplace ID and password using TCP/IP to the respective marketplace each time that you transact with that particular marketplace. As a Seller, you may always change or eliminate a market ID and password from our system by visiting the "Settings > Marketplace Settings" section of our website and updating our records. Andale also confirms the credit card information you provided with financial institutions in order to facilitate payment for services rendered.

If you utilize Andale's services as a Buyer, we pass on the contact and payment information you provided to the Seller from whom you have made a purchase. We also provide your contact and payment information to the Sellers' payment processor, as directed by you, each time you transact with that particular Seller.

Please note that Andale has links to other web sites. When you click on one of these links, you leave Andale and go to another web site. We encourage you to read the privacy statements of these sites, to which we link, as their privacy policy may differ from ours.

WHAT ARE "COOKIES" AND HOW ARE THEY USED?

A "cookie" is a small amount of data sent to your browser from a web server and stored on your computer's hard drive. Your browser must allow cookies in order for you to use the Andale service. We use cookies to hold information, such as a Seller's login ID or a Buyer's session number, so you don't need to re-enter information each time you utilize an Andale service during a session. We also use cookies to provide customized and personalized services to you. In addition, when we run marketing campaigns, we use cookies to evaluate their effectiveness. A large majority of the sites on the Internet use cookies. Should you choose to set your browser to reject cookies, you will render it nearly impossible to use sites that set and use cookies, including Andale.

We work with various third parties to provide services on our site including ad serving, reporting, and personalization. In the provision of these services, these companies may place cookies on your machine and may collect certain anonymous information about your visit to this and other web sites.

WHAT SECURITY MEASURES DOES ANDALE HAVE IN PLACE TO PROTECT YOUR PERSONAL INFORMATION?

Andale considers the security of your personal information, especially your credit card information, to be of utmost importance. Andale servers are protected at a premium, full-security data center. We protect your data through multiple security layers of defense (including the industry-standard secure server software (SSL), which encrypts all information you input before it is sent to us) and a series of secured and fire walled server systems. We engage leading Internet security/intrusion detection firms to maintain and audit security measures for our systems and we research new security technologies to further safeguard your privacy.

In order to protect the security of your information, your Andale accounts are password protected. In the interest of privacy and security, we automatically log you out of your account when a specific period goes by without activity.

HOW CAN I REVIEW AND CHANGE MY INFORMATION AND CANCEL MY ANDALE ACCOUNT?

You can edit and change your information in your Andale account, including your password, at any time in the "My Andale" section of the Andale website. Should you forget your password, Andale can send it to you immediately via email, at your request. To cancel your account, please login to your account and click on the "My Andale" tab followed by the "Billing" link. Once on this page, scroll to the bottom and select "Close Account".

HOW I WILL KNOW ABOUT CHANGES TO ANDALE'S PRIVACY POLICY

If we decide to change our privacy policy, we will post those changes on the "Start Page" of our site so that our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we shall notify users by way of this posting. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.
